Drug cases are probably the most common reason of arrest in California. It is most of the time associated with DUI because the arrests are made not only driving under the influence of alcohol, but also under the influence of drugs and or possession of cocaine or other drugs.

  • What is a drug offense?

Possession, use, sale or furnishing of any drug or intoxicating substance or drug paraphernalia, that is prohibited by law is considered a drug offense, which is a felony. Depending on the substance in possession and its amount, it can be considered a misdemeanor, like less than an ounce of marihuana. However, possession of drugs like cocaine, even in its tinniest amount, is considered a felony.

 

  • Penalties: The severe penalties are charged based on quantity of the drug and its schedule classification, the intent to sell or distribute and other circumstances. Aggravating situations can be, the possession of weapons or their use, evidence proving your selling, etc. However, in California, treating non-violent drug offenders by having them complete a drug treatment is preferable, rather than sending them to jail.

 

  • Club drugs: Drugs popular in dance clubs, such as Ecstasy, Rohypnol, GHB and ketamine. Ecstasy is often used in parties producing a stimulant effect that enables the one that takes it to remain active for longer periods of time.  Rohypnol and GHB are known in sexual assaults or rape cases, where their sedative effects allow the offender to attack its victim. Ketamine is generally used in animals, but drug takers use it as an hallucinatory substance.
